1. A&L offers on its Website the online sale of a vast selection of equipment, products, accessories and liquid refills for electronic cigarettes (hereafter the 'Products'), exclusively intended for individuals aged 18 and up.
In accordance with article L. 3511-2-1 of the Code de la Santé Publique, the sale of liquids destined to be used with an electronic cigarette, containing nicotine or not, is indeed prohibited to minors of less than eighteen (18) years of age.
2. The access and browsing of the Website are entirely free, apart from the costs relative to the equipment, communication tools and Internet connexion necessary to access and use the Website. These aforementioned costs remain at the sole expense of the User.
3. For any question regarding the Website's operation, the Products and their use, the User is encouraged to contact the Publisher at the address mentioned in article 5.
2. ACCESS AND AVAILABILITY
1. Access to the Website is free and continuously and permanently guaranteed, except in cases of acts of God or events beyond the publisher's control, and subject to any breakdowns, technical interventions, maintenance and updating necessary to the Website's proper functioning.
2. Furthermore, due to the Internet's nature, the Publisher cannot guarantee the Website functioning 24 hours a day, 7 days a week.
3. RESPONSIBILITY
1. The Publisher endeavours to offer the Users the most reliable and qualitative information on its Website.
2. However, the Publisher does not guarantee the comprehensiveness of the information published on the Website, neither its conformity in regards to what the Users wish to do with it, notably in regards to the compatibility of the purchased Products with the ones they use, whether it concerns equipment or liquids. Consequently, the Users acknowledge using this information under their sole responsibility.
Thus, the Publisher cannot be held responsible for the direct or indirect damages suffered by the Users or third parties that would find their source within the information published on the Website, and more generally, when consulting and using the Website.
3. Furthermore, the Publisher does not monitor the websites linked to the Website by means of hypertext links, and is not responsible for these websites and their content.
4. INTELLECTUAL PROPERTY
1. All the visuals and photographs visible on the Website are necessarily protected by copyright and all other intellectual property rights and belong to the Publisher or to third parties who have allowed the Publisher to use them. Any reproduction and/or representation of any kind, without permission, of a visual or photography displayed on the Website constitutes a counterfeit and will be subject to prosecution.

The same applies to all other data, whatever it can be, including texts, graphics, logos, icons, images, photographs, audio or video clips, brands, software and Website characteristics featured on the Website, which are necessarily protected by copyright, trademark and all other intellectual property rights, and belong to the Publisher or to third parties who have allowed the Publisher to use them.
3. The Publisher, as the Website's editor, allows the User a private, non-collective and non-exclusive right of use regarding the data aforementioned in articles 4.1 and 4.2.
The User must not copy, resume, modify, alter or re-disseminate, without prior authorization from the Publisher, any text, title, application, graphic charter, brand, information or illustration for any public use, which excludes any commercial representation or redistribution.
4. Any creation of hypertext links from an external website towards the Website will have to be authorised beforehand by the Publisher, this authorisation can be withdrawn at any time by the Publisher without having to justify his decision.

6. PRIVACY POLICY
1. In accordance with the provisions of the law n° 78-17 of 6th January 1978 relative to computing, data and liberties, A&L declared to the CNIL the conformity of its client-prospect file in regards to the NS-048 regulation.
2. The personal data of the Users, directly collected through the intermediary of forms and indirectly through their browsing towards and on the Website, and all future information, are intended for the sole use of the Publisher to process and fulfil the User's orders, as well as answer any questions they may have, and are not shared with any third parties except for the technical contractors in charge of managing the Website, who are required to respect the confidentiality of the information and to only use it for the the very precise operation they are intervening on.
3. The Users have, in accordance with the 6th January 1978 Law and the EU Regulation 2016/679 of 27th April 2016 relative to data protection, the right to access their data collected by the Publisher, as well as a right to modify, rectify, delete and transfer them. They can also oppose any processing of their data, which implies however that their orders cannot be processed or that the Publisher cannot answer their demands.
4. To exert their rights, the Users simply need to write a letter or email to the addresses aforementioned in article 5.
A&L will reply within a maximum of two (2) working days following the reception of the demand.
5. A&L retains the User's personal data on its own servers and commits to guarantee the privacy, safety and integrity of this data, which will be stored for one (1) year after the potential closure of the User Account by the User, one (1) year after the last query or contact via the Website, one (1) year after unsubscribing from a newsletter, if they had subscribed beforehand.
This data is then archived with a restricted and safe access for an extra 9 years for strictly limited reasons that are authorised by the law (for payment or accounting purposes for example).
6. The User is informed and has authorised the Website's necessary workings in regards to the « cookie » files saved onto the Users' computer hard drive.
Cookies contain no personal information, they are files saved onto the Users' computer hard drive.
Thus, A&L uses several types of cookies on its Website:
(i) cookies that facilitate the User's browsing on said Website, as well as using the offered services - this cookie is destroyed 10 days after each session, ie, when the Client disconnects
(ii) a cookie when using the chat service - this cookie is destroyed within a year following each chat session.

VARIOUS
1. The Publisher reserves the right to unilaterally modify the Terms of said conditions.
The new provisions will govern in the future all relations between parties, and only the new versions will apply.
2. These Terms of Use are regulated by French law, for the substantive and formal rules, and only the French version is valid in regards to their interpretation. Any dispute resulting from the application or interpretation of the Terms's provisions obliges the parties to get in contact and try and find an amicable agreement to their dispute, before seizing the competent jurisdiction.
